1. Agreement to Terms
Welcome to Rob's Path. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Prado Group Pty Ltd, trading as Rob's Path ("we," "us," or "our"), governing your access to and use of robspath.com (the "Site") and any products, services, or content we offer (collectively, the "Services").
By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
2. Changes to Terms

Your continued use of the Services after the notice period constitutes acceptance of the revised Terms. If you do not agree to the changes, you may stop using our Services and request a refund in accordance with our Refund Policy for any unused portion of Services.
3. Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
4. Account Registration
4.1 Account Creation
To access certain features of our Services, you may be required to create an account. You agree to:

- Notify us immediately of any unauthorized use
4.2 Account Security

However, you will not be held liable for losses caused by unauthorised use that occurs despite your reasonable security precautions.
5. Products and Services
5.1 Description
We offer digital products, courses, coaching, and other services as described on our Site. We will provide reasonable notice before discontinuing any product or service that you have purchased and ongoing access to.
5.2 Accuracy
We make reasonable efforts to ensure that product descriptions, pricing, and availability information on our Site are accurate. If we discover a pricing error after you've made a purchase, we will notify you and give you the option to proceed at the correct price or receive a full refund.
5.3 Product Updates
For digital products and courses, we may provide updates and improvements at no additional cost. We will notify you of significant updates to products you have purchased.
6. Purchases and Payment
6.1 Pricing
All prices are displayed in USD. Customers are responsible for any currency conversion fees charged by their bank or payment provider. While we reserve the right to change prices for future purchases, any price changes will not affect orders already placed or subscriptions already active at the time of the change.
6.2 Payment Processing
Payments are processed securely through Stripe. By providing payment information, you:
- Authorise us to charge your payment method for all purchases you make
- Represent that you are authorised to use the payment method provided
- Agree to pay all charges incurred by you
6.3 Payment Plans
If you choose a payment plan:
- Terms will be clearly stated at checkout
- You must maintain valid payment information
- Missed payments will result in a grace period of 7 days before access is suspended
- We will attempt to contact you before suspending access
6.4 Billing Disputes
If you believe you have been incorrectly charged, please contact us within 60 days of the charge. We will investigate promptly and provide a resolution within 14 business days.

7.1 Our Guarantee
We stand behind the quality of our products and services. If you are not satisfied with your purchase, you may request a full refund within 30 days of purchase, provided you meet the conditions outlined in our Refund Policy.
7.2 Refund Process
To request a refund:

- Provide your order number and reason for the refund request
- We will process your refund within 14 business days
7.3 Australian Consumer Law
Nothing in these Terms limits your rights under Australian Consumer Law. You have rights to a remedy if:

- Products or services are not fit for purpose
- Products or services do not match their description

8. Access and License
8.1 License Grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal or internal business use.
8.2 Reasonable Use Restrictions
You agree not to:
- Use our Services for any illegal purpose
- Use automated systems (bots, scrapers) to access our Services in a way that burdens our systems
- Attempt to gain unauthorized access to our Services or systems
- Interfere with or disrupt the integrity or performance of our Services
8.3 Digital Content Usage
Digital products and content purchased from us are licensed for your personal use. You may:
- Access the content on multiple devices you own
- Download content where we explicitly provide that option

You retain ownership of your content, and you may request removal of your content at any time (though we may retain copies as required by law or legitimate business purposes).

We welcome your feedback and suggestions. Any feedback you provide may be used by us without obligation or compensation to you, but we will not share your personal information in connection with that feedback without your permission.
10. Service Availability and Support
10.1 Reasonable Efforts
We will make reasonable efforts to ensure our Services are available and functional. However, we may need to perform maintenance, updates, or repairs that temporarily affect availability. We will provide advance notice of planned maintenance where reasonably possible.

We provide customer support via email at support@robspath.com. We aim to respond to support inquiries within 2 business days. Support hours and response times may vary based on volume, complexity of requests, and events outside of our control.
11. Disclaimers and Limitations
11.1 Educational Nature

- We do not guarantee specific results or outcomes
- Past results or examples do not guarantee future results
- You are responsible for your own decisions and actions
11.2 Professional Advice

11.3 Service Availability

11.4 Limitation of Liability
To the extent permitted by law:

- Our total liability for any claim related to our Services is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater
Important: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under Australian Consumer Law that cannot be lawfully excluded. Where we are liable for breach of a consumer guarantee, our liability is limited (to the extent permitted by law) to:
- For goods: repair, replacement, or refund
- For services: re-supply of services or payment of the cost of re-supply
12. Your Responsibilities
You agree to:
- Use our Services in compliance with all applicable laws
- Not misuse or abuse our Services or support systems
- Maintain the confidentiality of your account
- Notify us of any security breaches
- Provide accurate information
If your use of our Services causes us harm or liability, you agree to compensate us for reasonable costs directly caused by your wrongful conduct.
13. Third-Party Services
Our Site integrates with third-party services (including Stripe, Facebook, Pinterest, Google). These services have their own terms and privacy policies. While we choose reputable providers, we are not responsible for their practices or any issues arising from their services. We will cooperate with you to resolve issues involving third-party services where reasonably possible.
14. Termination
14.1 Your Right to Terminate
You may stop using our Services at any time. For purchased products with ongoing access, you will retain access through the end of any paid period, and our 30-day money-back guarantee applies where eligible.
14.2 Our Right to Terminate
We may suspend or terminate your access if:
- You materially breach these Terms after receiving notice and reasonable opportunity to cure (where curable)
- You engage in fraudulent, abusive, or illegal activity
- Required by law
Before terminating for breach, we will provide notice and opportunity to remedy the issue unless immediate termination is necessary to protect our Services or other users.
14.3 Effect of Termination
Upon termination:
- Your access rights cease, but you retain access to any downloaded content obtained during your authorized access period
- Refund rights are governed by our Refund Policy and Australian Consumer Law
- Both parties remain bound by obligations that reasonably should survive (payment obligations, liability limitations, dispute resolution)
15. Dispute Resolution
15.1 Good Faith Resolution
We value our relationship with you and want to resolve any concerns fairly. Before pursuing formal legal action, both parties agree to:
- Contact the other party in writing describing the issue
- Engage in good faith negotiations for at least 30 days
- Consider mediation or other alternative dispute resolution if negotiations don't resolve the matter
15.2 Governing Law
These Terms are governed by the laws of Queensland, Australia.
15.3 Jurisdiction
For any disputes that cannot be resolved through the process above, both parties agree to the jurisdiction of the courts of Queensland, Australia.
15.4 Small Claims
Either party may bring an individual action in small claims court if the claim qualifies and remains in small claims court.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding our Services.
16.2 Severability
If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
16.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
16.4 Assignment
Neither party may assign these Terms without the other's consent, except that we may assign to a successor in connection with a merger, acquisition, or sale of assets, provided the successor agrees to honour these Terms.
16.5 Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control (acts of God, war, pandemic, telecommunications failures, government actions, etc.). If such circumstances prevent performance for more than 90 days, either party may terminate affected Services with pro-rated refund of prepaid amounts.
16.6 Notices
Legal notices should be sent via email with confirmation of receipt. We will send notices to the email address associated with your account. You should send notices to legal@robspath.com.

16.8 Language
If we provide a translation of these Terms, the English version governs in case of any conflict.
16.9 Interpretation
These Terms will be interpreted fairly and reasonably, without giving preference to either party's role in drafting them.
